USA to announce criminal charges related to China's Huawei

She was arrested on December 1 in Canada.

Senior officials of the Trump administration gathered at the Department of Justice in Washington to announce criminal indictments against Huawei, the largest Chinese smartphone maker; its USA affiliate; the Hong Kong-based Skycom; and Meng Wanzhou, Huawei's chief financial officer, for conspiracy that poses a national security threat to the US.

In a 13-count indictment filed in NY, the Justice Department said Huawei misled a global bank and US authorities about its relationship with the subsidiaries, SkycomTech and Huawei Device USA Inc, in order to conduct business in Iran.

Prosecutors also allege that Huawei stole trade secrets, including the technology behind a robotic device that T-Mobile used to test smartphones, prosecutors said. Huawei has said the two companies settled their disputes in 2017.

More specifically, Huawei and Skycom were charged with bank fraud and conspiracy to commit bank fraud, wire fraud and conspiracy to commit wire fraud.

"These are very serious actions by a company that appears to be using corporate espionage and sanctions violations to not only enhance, potentially, their bottom line, but also to compete in the world economy", Whitaker said. Meng "personally made a presentation in August 2013 to an executive of one of Huawei's major banking partners in which she repeatedly lied about the relationship", prosecutors said in a statement announcing the charges.

Meng was arrested in early December 2018 by Canadian authorities at the request of the USA over allegations that she had committed fraud in sidestepping sanctions.

Despite China's protest, United States prosecutors are now seeking the CFO's extradition to the US. President Donald Trump's own musings fuelled speculation that the US might be planning to use the case as leverage in its trade negotiations with China. Meng is free in Vancouver, staying at her $4.2 million mansion with Global Positioning System monitoring, after posting bail of $10 million as she fights extradition to the U.S.to face criminal charges.

Canada arrested Meng at the request of the United States.

The charges come just two days before the Trump administration plans to resume trade talks with the Chinese government in Washington.

White House spokeswoman Sarah Sanders says the two developments are unrelated.
