Florida man shot, killed during parking spot dispute

Florida deputies said deadly shooting Thursday at a convenience store near Clearwater stemmed from a petty argument over a parking spot.

The Pinellas County Sheriff's Department has ultimately decided not to press charges against Michael Drejka, whom they deemed acted within the bounds of Florida's self-defense law known universally as "Stand Your Ground".

Surveillance video of the incident shows that McGlockton was riding in a 2016 Chrysler 2000 driven by his girlfriend Britany Jacobs, 25, when she pulled into the parking lot of the Circle-A Food Store at 3.27pm.

The store owner said that Drejka has a history of assaulting people in the very parking lot the shooting took place. McGlockton went into the store, along with the oldest child. He says prosecutors could still charge the shooter but Gualtieri's comments might make that hard. Drejka fell to the ground, drew his gun, and shot McGlockton once in the chest.

Bob Gualtieri, the Pinellas County Sheriff insists he has to follow stand your ground law, which dictates that if a person feels threatened they have the right to shoot.

"They [ask], 'Can we prove this case beyond a reasonable doubt?' and if you have the sheriff standing up in front of a podium saying, 'We don't have probable cause to even believe he should be arrested, ' it's going to be hard for the State Attorney's Office to turn around and say, 'Well, we think he should be prosecuted, '" Rickman explained.

The Tampa Bay Times reported that on Thursday in the town of Pinellas, a man named Michael Drejka approached Britany Jacobs' vehicle to tell her she was parked in a handicapped spot and needed to move.

A representative from the state attorney's office did not immediately respond to a request for comment on Saturday.

A few months ago, according to the Tampa Bay Times, Rick Kelly parked his tanker truck in the same handicapped spot and said he was confronted by Drejka. "Drejka told deputies he placed his firearm in his Toyota 4-Runner prior to their arrival", police said. The law exempts people who use force from prosecution if they fear for their lives.

Drejka has a valid Florida concealed weapons license, deputies said.

That action, and the seconds that followed it, have thrust the dispute over the handicap parking spot into the nationwide debate about "stand your ground" laws.
