Australian actress Rebel Wilson's $4.6 m defamation payout cut to $600,000

Australian actress Rebel Wilson's $4.6 m defamation payout cut to $600,000

Magazine publisher Bauer Media has had a major win in its appeal over Rebel Wilson's defamation suit and will now have to pay the actress $600,000.

"As I've said before, I have already won the case and this is unchallenged!"

During the trial, Wilson said her agents had advised her to stop mentioning her age - which was reported to be 29 in 2015 - because "Hollywood is very ageist, especially towards women".

The Court of Appeal has reduced the general damages payout to $600,000, and has found the special damages to have been wrongly awarded.

In court a year ago, she successfully argued that eight articles published by Bauer magazines in 2015 had portrayed her as a serial liar, and that this resulted in her being sacked from two feature films.

Wilson, 38, was not present in court when the Court of Appeal handed down its ruling and published a 252-page judgment on Thursday.

Wilson claimed she lost film roles as a result of the articles and in September she was awarded the largest defamation payout in Australian legal history.

The $4.5 million figure far exceeded the $389,500 statutory cap that media companies have previously relied on to protect them in defamation cases.

Speaking on behalf of Bauer Media, general counsel, Adrian Goss, said: "It was important for us to revisit the award of damages".

Wilson was originally awarded $3.9m (£2.3m) for loss of earnings and $650,000 (£382,000) in damages. And that while it's not about the money, she'd like to cop as much as possible so she can donate it all to charity and the Aussie film industry.

But regardless of how much in damages she's awarded, Wilson said she still considers herself a victor.

Wilson is now in Europe in pre-production on Taika Waititi's war-drama Jojo Rabbit but she tweeted that the case was "never about the money" and that proceeds would be going to charity.
