VirnetX shares surge as jury says Apple infringed patents

In 2012, Apple lost a $368.2 million lawsuit from VirnetX, though that verdict was later thrown out, paving the way for retrials and additional disputes. The two companies have been battling it out in court over various patent cases for 8 years, the most recent case pertains to Apple's iMessenger and FaceTime technology.

Apple has been ordered to pay $502.6 million in damages after a federal jury in Eastern Texas found that the company had violated patents owned by VirnetX.

In 2017 however, Apple filed an appeal against the USA district court verdict, though it lost the case. "The evidence was clear", Kendall Larsen said to reporters following the announcement of the verdict.

The legal battle started in 2010 and had bounced between courts and trials.

Bloomberg notes, however, that this could be a short-lived victory for VirnetX.

If this feels familiar, it's because we've been here before, and Apple isn't VirnetX's only target. There have been multiple trials, most recently one involving earlier versions of the Apple devices.

VirnetX originally sought damages pursuant with "cumulative product sales" of Apple's iPhone 5, fourth-generation iPad, Mac computers running OS X Mountain Lion and other devices boasting the company's bundled FaceTime, iMessage, and VPN software.

The case is now being reviewed by the Court of Appeals for the Federal Circuit in Washington, which will determine whether or not VirnetX's patents are actually invalid. It wasn't until last October that the court made a decision, awarding VirnetX with $439.7 million in damages. That's because PTAB believes VirnetX's patents are invalid even for cases now in progress.
