A Second Court Blocked Trump's Bid to End DACA

The issue was brought to the judge when several DACA recipients, known as "Dreamers", and 17 attorneys general led by New York AG Eric Schneiderman sued the federal government for the September 5, 2017 decision to end the program. "The court concludes that defendants have not done so".

"It's not just an ad hoc comment that was overheard on an open mic", the judge said.

Roughly seven months into his term, Trump called for the program's end saying it was unconstitutionally established by President Barack Obama in 2012.

There are approximately 700,000 DACA beneficiaries, though the administration is not required to process new applications.

The legal battle over DACA complicates a debate now underway in Congress on whether to change the nation's immigration laws. Alsup explained that the Department of Homeland Security's "decision to rescind DACA was based on a flawed legal premise".

Judge Garaufis is the second federal judge to rule Mr. Trump's aides bungled the phaseout, following a case in a federal court in California.

CNN reports that the Supreme Court is planning to meet behind closed doors this week to decide whether they will take up the Trump administration's appeal of the injunctions. He then offered Congress to come up with a permanent solution by March. He said that the courts will vindicate the administration's position that it acted properly in ending the program.

Judge Garaufis said that was not a compelling argument, and said DACA is neither unconstitutional nor illegal.

"The court is not pleased", the judge wrote in a footnote. That program granted the right to work and stay in the US without fear of deportation to about 700,000 young immigrants.

This ruling is rather odd on several fronts. But he followed that up by ruling that the government still had to accept renewal applications from people now in the program.

CHIRLA is helping incentivize applicants by offering to pay the $495 USCIS renewal fee. He said most of those applying had DACA protections, had seen them expire, and are now rushing to renew them to ensure they can continue to work.

Several East Coast organizations contacted by The Washington Times did not respond to messages about how their sign-ups were going.
