Boeing loses trade case over Bombardier passenger jets

Bombardier Inc. of Canada on Friday won its trade dispute with aerospace giant Boeing.

MONTREAL-The heated battle between Boeing Co. and Bombardier Inc. over C Series sales in the United States will likely drag on regardless which side comes up short January 26 in a U.S. International Trade Commission ruling.

The decision is going to help Bombardier sell its CSeries in the US through removing uncertainty during a time when its rival from Brazil Embraer is bringing a new jet into the market, said a source who is familiar with the thinking of the plane and train maker in Canada.

"Today's decision is a victory for innovation, competition and the rule of law".

A spokesperson for Boeing said it was "disappointed" by the ITC's decision and that it would "review the detailed conclusions when they are released".

Delta Air Lines was expected to receive the first of its firm order for 75 CS100 planes in the spring, but now plans to wait until the aircraft destined for USA customers is built in Alabama. "The C-Series is now ready for take-off".

BBC reports that the company - which is based in Canada - will now not have to pay the tariffs, after the US International Trade Commission voted to reject Boeing's complaints by four votes to zero.

X Aerospace stocks Boeing (BA) and Airbus (EADSY) will be in focus tomorrow, when the U.S. International Trade Commission is expected to rule on a massive tariff the Commerce Department imposed against Bombardier's new narrow-body jet.

Boeing said it would "continue to document any harm to Boeing and our extensive US supply chain that results from illegal subsidies and dumped pricing".

Airbus took a majority stake in Bombardier's C-series passenger jet programme in October previous year, which was hoped would help the jet programme overcome the tariff ruling.

Taoiseach Leo Varadkar tweeted: "Very pleased that Bombardier won its case to stop U.S. trade trade tariffs at the ITC. We are full-speed ahead", Bombardier tells FlightGlobal. "It is also a victory for US airlines and the USA traveling public".

Boeing said it would review the trade panel's finding and vowed to protect USA industry from "illegal business practices" at Bombardier.

Late previous year, Canadian officials made good on an earlier threat to cancel a proposed purchase of F/A-18 Super Hornet fighter planes, dealing a blow to Boeing's defense contracting business.

On Friday the ITC said United States companies and workers were not being harmed by sales of 100- to-150-seat aircraft from Canada.

But the four-member commission ruled unanimously that "100- to 150-seat large civil aircraft from Canada do not injure US industry".

Politicians and union leaders have welcomed a ruling which stops the United States imposing huge 292 per cent import tariffs on planes partly made by British workers.

Bombardier shares spiked 19 per cent on the news to $3.67.

Delta Air Lines Inc. said it looks forward to introducing the CS100 to its fleet.

"The case serves as an important reminder of the need to focus on enterprise, investment and skills to ensure Northern Ireland stakes its claim as a resilient, competitive place to do business in a rapidly changing global economy".
