Then, in November 2009, Rubashkin was convicted of 86 counts of financial fraud, including bank fraud, mail and wire fraud and money laundering, and in June 2010 was sentenced to 27 years in a Federal Correctional Institution in Mount Hope, New York.

Donald Trump has used his power to commute a prison sentence for the first time, freeing a millionaire businessman who was convicted of fraud and given a 27-year term behind bars.

"Mr. Rubashkin has now served more than 8 years of that sentence, which many have called excessive in light of its disparity with sentences imposed for similar crimes", President Trump's announcement noted, reflecting deep resentments over the exceptionally harsh sentence in the Jewish community as well as in the legal community at the time of the trial. Immigration and Customs Enforcement agents raided the plant in May 2008 and arrested almost 400 Mexican and Guatemalan immigrants who were living and working in the country illegally.

"Mr. Rubashkin is a devoted husband and father, a deeply religious man who simply doesn't deserve a sentence of this length, or anything remotely close to it", the letter continued. In 2009, he was convicted of bank fraud and sentenced thereafter to 27 years in prison.

This action is not a Presidential pardon.

Rubaskin oversaw operations at Agriprocessors' family-owned meatpacking plant in Northern Iowa, which was the country's largest kosher meat producer.

The White House said the president's decision to review Rubashkin's sentence was driven by concerns raised by a bipartisan group of more than 100 former high-ranking law enforcement and Justice Department officials, including multiple former attorneys general, as well as prosecutors, judges, and legal scholars.

In a statement announcing the commutation, White House officials said they had received letters from more than 30 members of Congress, including several members of both parties, supporting an examination of the case. "President Trump has done what is right and just".

News of Rubashkin's commutation was greeted with joy among his community of Chabad-Lubavitch Jews in NY. "The unrelenting efforts on Rubashkin's behalf have finally paid off".

While Wednesday's decision marks Trump's first commutation, the President previously pardoned Joe Arpaio, the former sheriff of Arizona's Maricopa county in August.

The statement added that there was a vast bipartisan support in calling for Rubashkin's sentence to be reduced.

Rubashkin's attorneys previous year accused prosecutors of improperly interfering with the sale of Agriprocessors and depressing its sale price by millions.
