The New York City Police Department said Friday that a 2010 rape accusation against Harvey Weinstein is "credible" and the Hollywood mogul would have faced immediate arrest if he were now in the state and the incident was more recent.

Weinstein allegedly offered her a ride home to her Tribeca apartment, where de la Huerta said Weinstein demanded to come inside and have a drink. She told the publication that Weinstein then started to kiss her, and after she tried to brush him away, he pushed her onto the bed, with his trousers down, and lifted up her skirt.

Investigators in London and California were also looking into allegations made by women, but no other department has suggested allegations could result in criminal charges.

PEOPLE magazine reports there are 65 women who have accused Weinstein of sexual misconduct.

Polanski left the United States for France in 1977 after he was charged with raping a 13-year-old girl.

"We have an actual case here, so we are happy with where the investigation is right now".

"Immediately when we got inside the house, he started to kiss me and I kind of brushed [him] away", de la Huerta told the mag. She has publicly accused Weinstein of raping her twice in her apartment in 2010 and called police about it on October 26. "No doubt", Boyce said of Weinstein. "He raped me." She says she never heard from Weinstein again after that night.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they speak publicly, which de la Huerta and Guiterrez have done. Vance's office said the NYPD's investigators did not consult prosecutors in the sex crimes unit before arranging the meeting that led to the recording.

In a statement his representative said: "Any allegations of non-consensual sex are unequivocally denied by Mr Weinstein".
