Couple who defamed wedding photographer ordered to pay $1.2m in damages

A Dallas wedding photographer is feeling vindicated after a jury awarded her $1.08 million in a defamation suit after she says a newly married couple went on a smear campaign to destroy her reputation, all over a $125 fee.

The jury found blogger Neely Moldovan and her husband, Andrew, guilty of defamation after they hurled damaging statements that led to the closure of Polito's studio.

Polito said that after the wedding the Moldovans had requested that their wedding photos be forwarded to them, but that she reminded them that the contract said they must first submit an order form and pick an album cover photo, which costs $125.

A Dallas County jury deliberated for two hours Friday and saw evidence in court that "affirmed that Ms. Polito followed the terms of the contract signed by the couple and even sought to further explain the contract and satisfy their demands", the release said.

Politico went on to sue the couple and this week, a Dallas judge ordered that they pay the $1.08 million "for acting out of malice to disparage her and her business". When she reached out to the couple several days later, she learned they'd already contacted several news outlets to complain that she'd been "holding their photos hostage", according to the suit. He said the couple had no interest in speaking to reporters.

"I was proud of my accomplishments, what I have done", plaintiff Andrea Polito told the Dallas Morning News.

She told DallasNews.com she hopes that others who may be in a similar situation take away that they have to "fight for what's right and fight for your passion". She said that she typically booked nearly 100 weddings a year but after their angry campaign she only booked two weddings in 2015.

The couple also made "disparaging and defamatory statements" on social media and on wedding blogs, claiming the photographer "cheated" and "scammed people" and that their photos were being "held hostage".

Polito tells PetaPixel that prior to the NBC 5 story, her photography business was generating a "high six figures" from shooting photos alone (i.e.no coaching or seminars). She said she hopes her case serves as a lesson to anyone who posts falsehoods online.

The jury found the couple became upset and took to the internet and used the local news to lie about what happened.

"People knew me and my reputation". When the verdict was read I felt a little bit relieved, but most importantly I feel my reputation was restored to myself.

According to the Daily Mail, the Moldovans have the opportunity to appeal the ruling, although CBS noted that their lawyer had "no comment".
